Bhikkhunī Vibhaṅga

Pācittiya 113:  i.e. The bhikkhus' Pācittiya 17 Not to Expel a Bhikkhunī From a Lodging Belonging to the Saṇgha.

Origin story

1At one time the Buddha, the Master, was staying at Sāvatthī in the Jeta Grove, Anāthapiṇḍika’s Monastery. At that time the monks belonging to the group of seventeen were repairing a large dwelling nearby, intending to stay there for the rainy season. Monks from the group of six saw this and said: “These monks from the group of seventeen are repairing a dwelling. Let’s evict them." But some of them said: “Let’s wait until they’ve finished repairing it."

2Soon afterwards the monks from the group of six said to those from the group of seventeen: “Leave; we get this dwelling."

“Shouldn’t you have told us beforehand? We would have repaired another one."

“Doesn’t this dwelling belong to the Saṅgha?"

“Yes it does."

“Well then, leave; we get this dwelling."

“The dwelling is large. You can stay here and so can we."

Saying: “Leave; we get this dwelling," angry and displeased, they grabbed them by the neck and threw them out.

Because of this they cried, and monks asked them: “Why are you crying?"

“These monks from the group of six, being angry and displeased, evicted us from a dwelling belonging to the Saṅgha."

The monks of few desires … complained and criticised them: “How can those monks belonging to the group of six, being angry and displeased, evict other monks from a dwelling belonging to the Saṅgha?"

3After criticising those monks in many ways, they informed the Master. … “Is it true, monks, that you are doing this?" “It’s true, Master." The Buddha, the Master, criticised them: “ … Foolish men, how can you, being angry and displeased, evict other monks from a dwelling belonging to the Saṅgha? This will not give rise to confidence in those without it … And, monks, this training rule should be recited thus:

Final ruling

4“If a monk, angry and displeased, evicts another monk from a dwelling belonging to the Saṅgha, or gets him evicted, he commits an offence entailing confession."

Definitions

5A: whoever … Monk: … The monk who is ordained by a complete Saṅgha through a procedure of one motion and three announcements, which is unchallengeable and fit to stand; this sort of monk is meant in this case.


6Another monk: a different monk.

7Angry and displeased: discontent, having ill-will, hostile.

8Belonging to the Saṅgha: a dwelling given to the Saṅgha, given up to the Saṅgha.


9Evicts: if he takes hold of him in a room and throws him into the entrance area, he commits an offence entailing confession. If he takes hold of him in the entrance area and throws him outside, he commits an offence entailing confession. Even if he makes him go through many doors with one effort, he commits an offence entailing confession.

10Gets evicted: if he asks another, he commits an offence entailing confession. If he only asks once, then even if the other makes him go through many doors, he commits one offence entailing confession.

Permutations

11If it belongs to the Saṅgha, and he perceives it as belonging to the Saṅgha, and, being angry and displeased, he evicts him or gets him evicted, he commits an offence entailing confession. If it belongs to the Saṅgha, but he has doubts about it, and, being angry and displeased, he evicts him or gets him evicted, he commits an offence entailing confession. If it belongs to the Saṅgha, but he perceives it as belonging to an individual, and, being angry and displeased, he evicts him or gets him evicted, he commits an offence entailing confession.

12If he evicts a requisite belonging to him, or he gets it evicted, he commits an offence of bad conduct. If he evicts him from the vicinity of a dwelling, from the assembly-hall, from under a roof-cover, from the foot of a tree, from a space in the open air, or he gets him evicted, he commits an offence of bad conduct. If he evicts a requisite belonging to him from any of these places, or he gets it evicted, he commits an offence of bad conduct. If he evicts one who is not fully ordained from a dwelling, from the vicinity of a dwelling, from the assembly-hall, from under a roof-cover, from the foot of a tree, from a space in the open air, or he gets him evicted, he commits an offence of bad conduct. If he evicts a requisite belonging to that person from any of these places, or he gets it evicted, he commits an offence of bad conduct.

13If it belongs to an individual, but he perceives it as belonging to the Saṅgha, he commits an offence of bad conduct. If it belongs to an individual, but has doubt about it, he commits an offence of bad conduct. If it belongs to an individual, and he perceives it as belonging to an individual, but that individual is not himself, he commits an offence of bad conduct. If it belongs to himself, there is no offence.

Non-offences

14There is no offence: if he evicts, or gets evicted, one who is shameless; if he evicts, or gets evicted, a requisite belonging to that person; if he evicts, or gets evicted, one who is insane; if he evicts, or gets evicted, a requisite belonging to that person; if he evicts, or gets evicted, one who starts quarrels and disputes, and who creates issues in the midst of the Saṅgha; if he evicts, or gets evicted, a requisite belonging to that person; if he evicts, or gets evicted, a pupil or student who is not acting in the right way; if he evicts, or gets evicted, a requisite belonging to that person; if he is insane; if he is the first offender.

15The seventh rule, the training rule on evicting, is finished.

 

1p_2V_428, msdiv124Tena samayena buddho bhagavā sāvatthiyaṁ viharati jetavane anāthapiṇḍikassa ārāme. Tena kho pana samayena sattarasavaggiyā bhikkhū aññataraṁ paccantimaṁ mahāvihāraṁ paṭisaṅkharonti— "idha mayaṁ vassaṁ vasissāmā"ti. Addasaṁsu kho chabbaggiyā bhikkhū sattarasavaggiye bhikkhū vihāraṁ paṭisaṅkharonte. Disvāna evamāhaṁsu— "Ime, āvuso, sattarasavaggiyā bhikkhū vihāraṁ paṭisaṅkharonti. Handa ne vuṭṭhāpessāmā"ti. Ekacce evamāhaṁsu— "āgamethāvuso, yāva paṭisaṅkharonti; paṭisaṅkhate vuṭṭhāpessāmā"ti.

2p_2V_429Atha kho chabbaggiyā bhikkhū sattarasavaggiye bhikkhū etadavocuṁ: "uṭṭhethāvuso, amhākaṁ vihāro pāpuṇātī"ti.

"Nanu, āvuso, paṭikacceva ācikkhitabbaṁ, mayañcaññaṁ paṭisaṅkhareyyāmā"ti.

"Nanu, āvuso, saṇghiko vihāro"ti?

"Āmāvuso, saṇghiko vihāro"ti.

"Uṭṭhethāvuso, amhākaṁ vihāro pāpuṇātī"ti.

"Mahallako, āvuso, vihāro. Tumhepi vasatha, mayampi vasissāmā"ti.

"Uṭṭhethāvuso, amhākaṁ vihāro pāpuṇātī"ti kupitā anattamanā gīvāyaṁ gahetvā nikkaḍḍhanti.

Te nikkaḍḍhīyamānā rodanti. Bhikkhū evamāhaṁsu— "Kissa tumhe, āvuso, rodathā"ti?

"Ime, āvuso, chabbaggiyā bhikkhū kupitā anattamanā amhe saṇghikā vihārā nikkaḍḍhantī"ti.

Ye te bhikkhū appicchā … pe … te ujjhāyanti khiyyanti vipācenti: "Kathañhi nāma chabbaggiyā bhikkhū kupitā anattamanā bhikkhū saṇghikā vihārā nikkaḍḍhissantī"ti.

3p_2V_430Atha kho te bhikkhū chabbaggiye bhikkhū anekapariyāyena vigarahitvā bhagavato etamatthaṁ ārocesuṁ … pe … "Saccaṁ kira tumhe, bhikkhave, kupitā anattamanā bhikkhū saṇghikā vihārā nikkaḍḍhathā"ti? "Saccaṁ, bhagavā"ti. Vigarahi buddho bhagavā … pe … kathañhi nāma tumhe, moghapurisā, kupitā anattamanā bhikkhū saṇghikā vihārā nikkaḍḍhissatha? Netaṁ, moghapurisā, appasannānaṁ vā pasādāya … pe … evañca pana, bhikkhave, imaṁ sikkhāpadaṁ uddiseyyātha—
